ORDER

This petition has been filed seeking to transfer the investigation in Crime No. 4 of 2023 pending investigation before the 4th respondent to any other independent agency.

2. The learned counsel appearing for the petitioner submitted that the petitioner, is the defacto complainant, on whose instance, an FIR in Crime No.4 of 2023 was registered against one Jeyapaul and two others for the offences under Sections 420 and 120B of IPC with respect to default of money to the tune of Rs.80 lakhs. However, since there is no progress in the investigation, this petition came to be filed.

3. The learned Government Advocate appearing for the respondent police submitted that the accused namely Jeyapaul filed a writ petition before this Court in WP(MD)No.18783 of 2023, wherein this Court directed the fifth respondent herein to immediately act upon the proceedings of the Director General of Police, dated 26.10.2023 and to nominate an Investigating Officer to take up further investigation. Pursuant to the said order, the case was transferred to Economic Offences Wing vide proceedings dated 17.03.2025 in Rc.No.9560889/Crime.3(2)/2025 issued by the Director General of Police and Head of Police Force, Chennai.

4. Heard either sides and carefully perused the materials placed before this Court.

5. It is seen that now the case was transferred to Economic Offences Wing and hence, the Investigation Officer, Economic Offences Wing, Chennai, is suo motu impleaded as the eighth respondent in this case, for whom, Mr.B.Thanga Aravindh, learned Government Advocate takes notice. Registry is directed to carry out necessary amendment in this regard. 3/6

6. The eighth respondent police, who is to be nominated by the fifth respondent in this case is directed to conclude the investigation as expeditiously as possible within a period of four weeks from the date of nomination of the Officer concerned.

7. With the above direction, this Criminal Original Petition is disposed of.
