Respondents PRAYER:- Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, to call for the records connected with the impugned proceedings in Na.Ka.No.4302/A4/2022, dated 15.09.2022 on the file of the second respondent and to quash the same as illegal in accordance with law, within the time stipulated by this Court. 1/5

This Writ Petition has been filed challenging the impugned proceedings of the second respondent in Na.Ka.No.4302/A4/2022, dated 15.09.2022 and to quash the same.

When the matter is taken up for hearing today, the learned Additional Government Pleader appearing for the respondents would submit that it is only an enquiry notice issued by the District Registrar, Tiruchirapalli in Na.Ka.No.4302/A4/2022, dated 15.09.2022, directing the petitioner to appear before him on 18.10.2022 at 11.00 - 12.00 a.m. and give an explanation for the enquiry.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents. 2/5

Considering the submission made by the learned Additional Government Pleader, this Court is of the view that the District Registrar has got every right to call for an enquiry regarding the complaints received by him and the date fixed for enquiry is expired. Hence, this Court directs the District Registrar, Tiruchirappalli to issue fresh notice of hearing to the petitioner to enable him to participate in the enquiry and the petitioner is directed to appear and give an explanation if any before the District Registrar, Tiruchirappalli. On receipt of such explanation, the District Registrar, Tiruchirappalli is directed to pass appropriate orders, on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner.

5. With the above directions, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed. 17.11.2022 Index:Yes/No Internet:Yes/No akv 3/5
