Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a writ of Mandamus, directing the 1st Respondent to consider the Petitioners representation dated 02.01.2019 in the light of the G.O.Ms.No.570 Revenue Department dated 26.12.2014 and Rule 39(d) of Tamil Nadu State and Subordinate Service Rules and direct the 1st Respondent to promote the Petitioner as Village Administrative Officer in any one of the existing vacancies in Vilavancode Taluk, Kanyakumari Dist within the time stipulated by this Honble Court. 1/3

ORDER

It is stated by the learned Additional Government Pleader that pursuant to the order of this Court dated 18.02.2019 in W.P(MD). No.3571 of 2019, the petitioner's representation was considered and orders were passed rejecting his request for inclusion of his name in the panel and the order has also been acknowledged by the petitioner on 13.01.2020.

2.In view of the order dated 08.01.2020, the disobedience alleged by the petitioner cannot be termed as wilful disobedience. However, if the petitioner is aggrieved against non inclusion of his name in the panel, it is always open to him to challenge the same in accordance with law.
