PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to take action against the 2nd and 3rd respondents for not considering petitioner representations dated 18.03.2023, 06.04.2023, 21.07.2023, 09.08.2023 and 16.08.2023 and direct the 3rd respondent to seize petitioner all original documents and fabricated documents, to conduct further investigation and file additional final report in Crime No. 27 of 2011 on the file of the 3rd respondent. O R D E R

Expressing grievance over the manner of investigation this Writ Petition came to be filed seeking a direction to the third respondent to take up further investigation for the purpose of seizing the documents from the accused persons.

2. Learned Government Advocate submitted that the earlier 2/5

application filed by the petitioner was withdrawn by order dated 12.09.2023 in Crl.O.P(MD)No.12954 of 2023. Without disclosing the same, this petition has been filed.

3. The fifth respondent appeared before this Court in person and stated that the original documents are available with him. During the course of trial process, the documents, according to him, will be produced before the concerned Court.

4. Depending upon the order of the trial Court, further action may be taken. Since the grievance of the petitioner is redressed by way of an undertaking given by the fifth respondent herein, I find no further adjudication is required in this matter.

5. Recording the statement of the fifth respondent, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition stands closed.
