This writ petition has been filed for a mandamus seeking for a direction to the first respondent to regularize the service of the petitioner in the post of Driver with effect from the year 2000, by extending the benefit of G.O.Ms.No. 43, Labour and Employment (E2) Department, dated 26.04.2019, based on the petitioner's representation dated 16.05.2022, within a time frame to be fixed by this Court.

2. A counter-affidavit has been filed by the fourth respondent. However, as on date, the representation of the petitioner, as stated supra, has not been considered by the first respondent on merits and in accordance with law. The petitioner seeks for regularization of his service in the post of Driver with effect from the year 2000, by extending the benefit of G.O.Ms.No.43, Labour and Employment (E2) Department, dated 26.04.2019. 2/5

3. No prejudice would be caused to the respondents if the petitioner's representation dated 16.05.2022 is considered on merits and in accordance with law, within a time frame to be fixed by this Court.

4. For the foregoing reasons, this Writ Petition is disposed of by directing the first respondent to pass final orders on merits and in accordance with law, on the petitioner's representation dated 16.05.2022, seeking for regularization of his service in the post of Driver with effect from 2000, by extending the benefit of G.O.Ms.No.43, Labour and Employment (E2) Department, dated 26.04.2019, within a period of twelve (12) weeks from the date of receipt of a copy of this order. This Court has not expressed any opinion on the merits of the petitioner's case. No costs.
