O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first and second respondents herein to consider the petitioner's representation dated 28.08.2023 and delete the name of the third respondent from the petitioner's Patta No.3310, in respect of the property comprised in Survey No.385/8A, measuring an extent of 21 cents, situated at Palayam Village, Gujiliamparai Taluk, Dindigul District, as a joint pattadar.

2. The learned counsel for the petitioner submitted that though the third respondent has nothing to do with the land, a joint patta was issued including her name, which is incorrect.

3. The learned counsel for the third respondent submitted that she has been rightly included as a joint pattadar; that the property of the third Page No. 2 of 5

respondent, in respect of which the joint patta was issued, was sold to the fourth respondent; and that the present Writ Petition was filed only after the sale of the said property by the third respondent in favour of the fourth respondent.

4. This Court has not gone into the merits and demerits of the case, since the representation of the petitioner dated 28.08.2023, filed before the Department, has not yet been disposed of. In the event of there being any claims or counter-claims with regard to the rights over the property, the same shall be subject to civil proceedings. However, keeping in view the fact that the petitioner has submitted a representation dated 28.08.2023, it is for the first and second respondents to consider and dispose of the said representation on its own merits and in accordance with law.

Therefore, this Writ Petition is disposed of with a direction to the first and second respondents to consider the petitioner's representation dated 28.08.2023 on its own merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The said representation shall be considered Page No. 3 of 5

and disposed of after conducting an enquiry. The first and second respondents are also directed to afford a reasonable opportunity during such enquiry to the petitioner, the private respondents and any other interested parties who may be affected by the decision. In the event of any rival claims, the same may be agitated before the competent civil court. There shall be no order as to costs. Consequently, the connected Miscellaneous Petitions are closed.
