Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents herein to issue free house site patta in favour of the petitioner in respect of the property comprised in Old Survey No.47/30, New Town Survey No.81, WardA, Block No.5, situated at Chinnapuliyampatti Village, Aruppukottai Taluk, Virudhunagar District within a time stipulated by this Court by considering the petitioner's representation dated 20.06.2023 and pass order within a time stipulated by this Court.

ORDER

Heard the learned counsel on either side.

2. The petitioner is said to be using the petition mentioned site as cattle shed for the last several years. The petitioner wants patta to be issued in his favour.

3. When the matter was taken up for hearing, the learned Special Government Pleader would point out that in the revenue record, the petition mentioned survey number has been classified as public latrine.

4. The learned counsel for the petitioner states that no such public toilet is in existence on ground.

5. In these matters, it would not be open to the writ court to issue any positive direction. It is for the third respondent to consider the petitioner's request and take a call in the matter. Leaving the issue to the discretion of the third respondent, the Writ Petition is disposed of.
