[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] Seeking to suspend the sentence imposed on the petitioner by the II Additional District and Sessions Judge, Thoothukudi , vide Judgment dated 18.06.2024 in S.C.No.4 of 2018, he has filed this Criminal Miscellaneous Petition.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner has failed to make out a prima facie case for grant of suspension of sentence. Further while he was in bail during trial he committed two other offences and if he is enlarged on bail he will indulge in similar type of offence, hence we are of the opinion that it is not a fit case for grant of suspension of sentence to the petitioner.

4. Accordingly this Criminal Miscellaneous Petition stands dismissed.
