ORDER

The Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders to direct the Judicial Magistrate No.IV, Trichy to expedite the trial and to dispose of the case in S.T.C.No.5175 of 2019 within the time stipulated by this Court. 1/4

2. Since the petition is filed for early disposal of the case, issuance of notice to the respondent is not necessary.

3. The petitioner/complainant has filed a private complaint under Section 200 Cr.P.C. against the respondent for the offences under Sections 138 r/w 142 of Negotiable Instruments Act and the case was taken on file in S.T.C.No.5175 of 2019 and is pending on the file of the Judicial Magistrate No.IV, Trichy.

4. Even according to the petitioner, NBW came to be issued against the respondent and the same is pending.

5. It is not in dispute that warrant came to be issued on 04.12.2023.

6. Considering the above and taking note of the fact that the case is pending from 2019 onwards, the learned Judicial Magistrate No.IV, Trichy, is directed to send warrant to the jurisdictional Police for the earlier execution of the warrant and after executing the warrant, the learned Judicial Magistrate No.IV, Trichy, is directed to proceed with the 2/4

trial and dispose of the case as expeditiously as possible as per Section 143(3) of the Negotiable Instruments Act.

7. With the above direction, the Criminal Original Petition stands disposed of.
