O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] It is submitted by the learned Additional Government Pleader appearing for the respondents 2 & 3, on instructions, that the Chief Educational Officer / third respondent conducted a filed inspection and found that the subject house situates inside the school premises. It is an encroachment in the school property, which belongs to the Education Department.

2. Learned Government Pleader appearing for the first respondent,

on instructions, submitted that in this regard, the jurisdictional Tahsildar has initiated action and issued a notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 and after affording an opportunity to the encroacher, a final notice under Section 6 of the said Act was issued to the encroacher.

3. That being the factum, the respondents are directed to evict the encroacher immediately from the subject land to protect the school campus and the children studying in the subject school.

4. The Chief Educational Officer / third respondent is directed to ensure that a compound wall has been constructed within a period of three months from the date of receipt of a copy of this order in order to protect the land belongs to the school and to prevent any further encroachment in the school property.

5. With the above observation, this contempt petition is disposed of.
