RESPONDENT/COMPLAINANT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to Modify the condition 5(b) imposed in Crl.OP(MD)No.15844 of 2024 order dated 20.09.2024 upon the petitioner to appear before the respondent police daily at 10.30AM for a period of three weeks.
Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.G.ARAVINTHAN, Advocate for M/s.AARAN LEGAL CONSULTANCY, for the petitioner and of Mr.A.ALBERT JAMES, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- The learned counsel for the petitioner submits that the petitioner is harassed in 1/3
the police station and he is being made to wait for half a day.
2. The petitioner cannot expect the respondent police to get to stand in the doorstep of the police station with the notebook ready for him to sign and go away., it may take a while and at the same time the Court may be taken note to make the petitioner to wait for long.
3. The original order itself clearly states that the petitioner has to comply the condition for a period of three weeks no modification can be permitted.
4. The petitioner shall comply with the condition for a period of three weeks from tomorrow (24.10.2024).
5. This petition is ordered accordingly.
