Mr.A.Albert James Government Advocate (Crl.side) PRAYER :- For Bail in Crime No.119/2024 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 31.03.2024 for the offences punishable under Section 8(c) and 20(b)(ii)(C) and 25 of Narcotic Drugs and Psychotropic Substances Act, 1985 in crime No.119 of 2024 on 1/3
the file of the respondent Police seeks bail.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent Police and perused the materials available on record.
3. This application has been urgently moved on the ground that the petitioner's father had since passed away. The quantity of Ganja involved is a commercial quantity and therefore, the petitioner cannot be granted regular bail. However, considering the fact that the petitioner's father has since passed away on 16/10/2024, only to enable the petitioner to take part in the funeral and the rites, I am inclined to grant interim bail to the petitioner for a period 5 days from today with the following conditions.
i) The petitioner is granted interim bail for a a period of 5 days from today i.e., on 17.10.2024 to 21.10.2024. On these five days the petitioner shall also appear before the respondent Police Station twice a day i.e., on 10.00 am and 5.00 pm. ii) The petitioner shall report back to the Central Prison, Palayamkottai at about 5:00 pm on 21/10/2024;
iii) Considering the serious nature of case, even though interim bail is granted, it will be open for the respondent police to depute police personnel to keep watch over the accused all these five days.
