CORAM

THE HONOURABLE MR. JUSTICE M.DHANDAPANI CRP (MD). No.2950 of 2024 and 147 of 2025 and CMP(MD) No.16859 of 2024 and 969 of 2025 S.Vinothkumar ... Petitioner in CRP(MD) No.2950/2024 and respondent in CRP (MD) No.147/2025 Vs Ramya ... Respondent in CRP(MD) No.2950/2024 and Petitioner in CRP No.147/2025 COMMON PRAYER :-Civil Revision Petitions filed under Article 227 of The Constitution of India against the order dated 28.08.2024 in IA No. 2/2024 in HMOP No.594/2023 on the file of the Family Court, Theni. CRP(MD) No.147/2025 For Petitioner : Mr.S.Balaji For Respondent : Mr.S.Jawahar CRP(MD) No.2950/2024 For Petitioner : Mr.S.Jawahar For Respondent : Mr.S.Balaji COMMON ORDER Since the petitioner and the respondent are same and the issue involved in both the petitions are connected and the challenge made is against the same order, both the Civil Revision Petitions are disposed of 1/5

by this common order.

2. The husband filed HMOP No.594/2023 for divorce, in which the wife filed an IA No.2/2024 claiming interim maintenance. In the said petition, the trial Court has ordered for Rs.30,000/- each for the wife and child and in total, the husband was directed to pay a sum of Rs.60,000/- as interim maintenance from the date of petition and apart from the said interim maintenance, the husband was directed to pay Rs.10,000/- towards litigation expenses. Challenging the same, both the husband and wife are before this Court with these revision petitions.

3. The learned counsel for the husband would submit that the amount as ordered by the trial Court is exorbitant and it needs to be interfered with.

4. Per contra, the learned counsel for the wife would submit that the husband has every means to pay the interim maintenance, as he is running a company on his own and hence, the amount as ordered by the trial Court is very meagre and for enhancement, the wife is before this 2/5

Court. He would further submit that since the wife has to maintain herself and her child, the amount ordered is just and proper and hence, prays for enhancement.

5. I have considered the rival submissions and perused the materials available on record.

6. Considering the submissions made by both sides, since the interim maintenance amount is found to be just and proper, the trial Court has ordered for Rs.30,000/- each to the wife and the child. When the petitioner is running his own company, the interim maintenance of Rs.60,000/- is found to be very meagre and hence, no interference is warranted to the order made in IA NO.2/2024 dated 28.08.2024. Accordingly, CRP(MD) No.147/2025 stands disposed of and CRP(MD) No.2950/2024 stands dismissed. No costs. Consequently connected Miscellaneous Petitions are closed.
