ORDER
By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.
2. The writ petition has been filed for a mandamus directing the 1st and 2nd respondents to permit the petitioner to pay the Additional Security Deposit of Rs.11,37,994/- alone in 6 equal monthly installments, along with the regular current consumption charges.
3. The learned counsel for the petitioner states that the petitioner is the registered company and it availed the electricity connection under HTSC No.059094500131. Thereafter, the petitioner requested for HT service connection and the same was also given to the petitioner. Further, the respondent had directed the petitioner to pay a sum of Rs.11,37,994/- for the purpose of availing HT electricity service 2/5
connection and it was also informed that if the said amount is not paid within a period one month, the electricity service connection granted to the petitioner will be disconnected. Due to production loss and continuous recession in the industry, the petitioner was not in a position to pay the Current Consumption Deposit at once and hence, pleads before this Court to pay the Current Consumption Deposit in 6 equal monthly installments. He would further submit that this Court in similar circumstances, in W.P.(MD)No.16885 of 2022 dated 29.07.2022 has ordered for payment of amount in equal monthly installments, along with current consumption charges and the petitioner herein is also ready and willing to pay the Current Consumption Deposit by way of 6 monthly installments.
4.The learned counsel for the petitioner submits that the amount deposited in respect of HT service connection shall be adjusted towards the present demand made by the respondents.
4.The learned Standing Counsel appearing for the respondents submits that the demand amount has been arrived, only after adjusting 3/5
the amount deposited by the petitioner towards HT service connection and the respondents have no objection for payment of the consumption amount in installments.
5.Considering the facts and circumstances of the case and also having regard to the submissions made, this Writ Petition is disposed of directing the petitioner to pay the Current Consumption Deposit of Rs. 11,37,994/- in six (6) equal monthly installments along with regular current consumption charges, commencing from 01.11.2024, failing which it is open to the respondents to initiate appropriate action in accordance with law. No costs.
