4.Balsubramanian : Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 2nd respondent to dispose the proceeding in Na.Ka.No.3623/2021/A5 dated 21.09.2021 and consequently direct the official respondents not to interfere with the peaceful possession and enjoyment of petitioner's property in respect of lands in S.F.No. 41/2A to an extent of 0.43.50 and S.F.No.41/4 to an extent of 0.28.50 hectares 1/4

in Pattamudayan Village, Audaiyarkovil Taluk, Pudukkottai District, without following any due process of law.

O R D E R

This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the 2nd respondent to dispose the proceeding in Na.Ka.No. 3623/2021/A5, dated 21.09.2021 and consequently direct the official respondents not to interfere with the peaceful possession and enjoyment of petitioner's property in respect of the lands in S.F.No. 41/2A to an extent of 0.43.50 and S.F.No.41/4 to an extent of 0.28.50 hectares in Pattamudayan Village, Audaiyarkovil Taluk, Pudukkottai District.

2. Heard Mr.T.Vadivelan, learned counsel appearing for the petitioner and Mr.D.Gandhiraj, learned Special Government Pleader appearing for the respondents 1 to 3.

3. The learned Special Government Pleader appearing for the respondents 1 to 3 would submit that already this Court has passed an order in W.P. 2/4

(MD).No.13951 of 2020, dated 08.10.2020 and the official respondents have also given an undertaking that they are not interfering with the peaceful possession and enjoyment of the petitioner's property. In spite of that, again and again the petitioner has approached this Court.

4. In view of the above, this Court directs the second respondent to dispose of the proceedings in Na.Ka.No.3623/2021/A5, dated 21.09.2021, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs. 30.11.2022 akv To 1.The District Collector, Pudukottai District, Pudukottai.
