ORDER

The petitioner / A7 in CC.No.833 of 2022 on the file of the Principal Special Court for EC and NDPS Act Cases, Madurai was found guilty, convicted and sentenced to undergo 10 years rigorous imprisonment with a fine of Rs.10,00,000/-, 1/3

in default, to undergo 6 months simple imprisonment for the offence under Section 8 (c) r/w 20(b)(ii)(C), 25, 29(1) of the NDPS Act. As against the conviction, the petitioner has filed an appeal in CrlA(MD)No.936 of 2024 and it has been admitted by this Court. Along with the appeal, the petitioner has filed this petition to suspend the sentence.

2.The learned Counsel for the petitioner seeks time to proceed with the petition.

3. This petition was filed on 17.10.2024. Perusal of the order sheet shows that at the request of the petitioner this petition has been adjourned repeatedly. This petition is listed for 7th time for hearing. Even today the petitioner has sought an adjournment. Considering that the petition filed on 17.10.24 is kept pending without any progress, the petitioner is not interested in proceeding with this petition and keeping this petition anymore would serve no purpose, this petition is dismissed with liberty to the petitioner to renew the petition.
