JUDGMENT

[Judgment of the Court was made by R.SUBRAMANIAN, J.] The petitioner challenged his non selection to the post of Grade II Constable. Though the petitioner had obtained 85 marks, which is the cut off marks for MBC candidates, unfortunately the petitioner was not included in the selection list because he was born on 17.04.2003. Since several candidates had obtained 85 marks, the Department went by the date of birth and persons born upto 11.05.2000 were included in the selection list. The petitioner claims that he is entitled to half a mark extra because he has participated in sports. The certificate issued by the Department of Social Defence was evaluated by the Sports Development Authority and the authority had come to a conclusion that the certificate will not meet the requirements for grant of half a mark set out in the notification. Hence, he is not entitled to half a mark under the sports quota

2.Since the petitioner is not qualified for selection, the Writ Court has rightly rejected the claim. We do not see any reason to interfere with the order of the Writ Court.

3.Hence, the Writ Appeal fails and it is accordingly, dismissed. No Costs. Consequently, connected miscellaneous petitions are closed.
