JUDGMENT

(By G.R.SWAMINATHAN, J.) The appellant filed W.P(MD)No.16486 of 2013 challenging the appointment of the second respondent herein for the post of Village Assistant, S.Vakaikulam Village, Manamadurai Taluk. The writ petition was dismissed by the learned single Judge vide order dated 20.02.2018. Aggrieved by the same, this Writ Appeal has been filed.

2.The learned counsel appearing for the appellant reiterated all the contentions set out in the grounds of appeal and called upon us to admit the appeal and issue notice.

3.We are not inclined to admit the Writ Appeal. This is for more than one reason. It is seen from the order of the learned single Judge that the post in question was reserved for Scheduled Caste women. Admittedly the appellant is a male. Therefore, on this sole ground he may have to be disqualified. Secondly, the appointment was made way back in September 2012. We are 2/4

now in July 2025. The writ petition was dismissed after a gap of five years and this Writ Appeal has been listed for admission 7 years thereafter. In these circumstances disturbing the appointment of the second respondent would definitely lead to grave injustice. In this view of the matter, we decline to interfere.

4.The Writ Appeal is dismissed in the admission stage itself. There shall be no order as to costs. Consequently, connected miscellaneous petition is allowed.
