For Respondent : Mr.A.Albert James Government Advocate (Crl. side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For bail in Crime No.58 of 2024 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the alleged offence under Sections 279, 337 and 379 of IPC, in Crime No.58 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had illegally transported two units of river sand. Hence, the complaint.

3. Heard the learned counsel on either side and perused the material records of the case.

4. Considering the nature of allegation in this case that the petitioner is said to have involved in illegally transporting two units of river sand and the vehicle was also got involved in another accident and thereafter, the offence came to light and the petitioner is now roped in and considering the fact that the petitioner has got 14 previous cases, in which 6 cases are similar in nature and when the petitioner is continuously involving in the same kind of offences, in spite of the bail being granted in the earlier cases, this is not a fit case for grant of anticipatory bail. Already considering the entire issue, the earlier petition was dismissed on 12.09.2024 in Crl.OP(MD)No.15448 of 2024. It is to be noted that in spite of the dismissal of the earlier application on 12.09.2024, still the second application is being filed. When the second application came up before this Court, a wrong instruction is also given to the Government Advocate (Crl. side), as if no previous case is pending against the petitioner. This Court passed over the matter and subsequently it was 2/3

verified that the previous instruction that there are 14 cases against the petitioner is a correct information.
