This petition has been filed seeking to set aside the Fair and Decreetal Order dated 16.02.2019 made in E.P.No.95 of 2017, on the file of Learned Principal District Judge, Tiruchirappalli, in Arbitration award dated 06.11.2014 made in A.C.P.No.131 of 2017, on the file of the Sole Arbitrator, 2.Learned Counsel for the petitioner reported "no instructions". 3.The first respondent herein initiated arbitration proceedings for nonpayment of the chit amount and the award was passed on 06.11.2014 and for execution of the same, the first respondent has filed an execution petition in E.P.No.95 of 2017 on the file of the Principal District Judge, Tiruchirappalli and the same was ordered ex-parte on 16.02.2019. Challenging the same, the present Civil Revision Petition has been filed. 2/5
4.However, without challenging the arbitration award in the manner known to law, challenging the consequential execution petition is not maintainable.
5.Accordingly, this Civil Revision Petition is dismissed, with liberty to the petitioner to challenge the arbitration award in the manner known to law. There shall be no order as to costs. Consequently, the connected miscellaneous petition s closed.
