O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the fourth respondent to consider the petitioner's last representation dated 29.08.2023 and issue a joint patta in the name of the petitioner as well as in the name of the petitioner's brother's wife, Vijayalakshmi, in respect of the land situated in Survey No.100/10B2, at Thittukottai Village, Nedodai Group, Devakota Taluk, Sivagangai District, measuring an extent of 10 cents.

The grievance of the petitioner is that the petitioner and his brother's wife, namely Vijayalakshmi, jointly purchased the land comprised in Survey No.100/10B2, measuring an extent of 10 cents and submitted a petition on 28.05.2014 seeking subdivision in the name of the petitioner as well as the said Vijayalakshmi. After the Surveyor visited and measured the property, the subdivision was wrongly carried out by Page No. 2 of 6
erroneously including half of the subject property, i.e., 41⁄2 cents, in favour of one A.Gandhi.
3. On 19.09.2016, the petitioner submitted a petition before the Sub-Collector, Devakottai, seeking grant of joint patta. During the enquiry before the first respondent, the concerned Surveyor stated that while carrying out the survey of the land adjacent to the property purchased by the petitioner, the survey number had been wrongly mentioned in the village map in the name of the said Gandhi. Based on the said statement, the Sub-Collector, Devakottai, informed the petitioner that his request would be considered and that the mistake would be rectified.
4. However, the third respondent closed the petitioner's petition without considering the same. Thereafter, the petitioner immediately approached the Surveyor, who assured that the mistake would be rectified. However, no steps were taken. Therefore, once again, the petitioner submitted a detailed representation dated 29.08.2023, which also did not evoke any response. Hence, the petitioner was constrained to file the present Writ Petition.

5. The learned Additional Government Pleader appearing for the respondents undertakes to consider the petitioner's representation and pass appropriate orders within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the fourth respondent to consider the petitioner's representation dated 29.08.2023 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The fourth respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner and to any other interested parties who may be affected by the decision. In the event of any rival claims, the same can be agitated before the competent civil court. No costs. Consequently, the connected Miscellaneous Petition is closed.
