O RDER This criminal original petition has been filed seeking speedy disposal in S.T.C No.464/2022 dated 27.04.2022 on the file of the Judicial Magistrate Court, Paramakudi against the petitioners within a stipulated time that may be fixed by this Court.
2.The petitioner is the defacto complainant in the C.C.No.464 of 2022 He gave a complaint before the respondent police, which was registered in Crime No. 403 of 2020, for the offence punishable under Sections 8(2), 20(b)(ii)(A) of NDPS Act. The grievance of the petitioner is that though the case was registered in the year 2020, so far no progress is made in the trial process. He would further submit that after the disposal of the above said case, he has to go back to the foreign country for his job.
3.The learned Government Advocate (Crl. Side) would submit that totally six witnesses to be examined in this case. He would further submit that the respondent police is ready to co-operate to complete the trial process within the 2/5
time stipulated by this Court. But, some of the accused persons in this case is still absconding. Therefore, trial could not be completed. 4.In view of the submissions on either side, there shall be a direction to the learned Judicial Magistrate, Paramakudi, to split up the case against the accused persons, those who are regularly appearing and expedite the trial process and dispose of the same within a period of five months from the date of receipt of a copy of this order.
5.With the above said directions, this criminal original petition is disposed of.
