PETITION FOR BAIL Under Sec.439 of Cr.P.C.
PRAYER :- For Bail in Crime No.216 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/ Accused apprehends arrest at the hands of the respondent police for the offences under Sections 294(b), 308 of IPC and 27(2), 29(a) of Arms Act, 1/4
in Crime No.216 of 2023, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 07.08.2023, at about 3 p.m., when the defacto complainant was riding his two wheeler, a car was driven in a rash and negligent manner. When the defacto complainant has questioned the driver of the four wheeler, some persons alighted from the car and threatened the defacto complainant by showing pistol, made a shot in order to threaten the defacto complainant and used filthy language. Hence the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that some of the accused are absconding and no previous case is pending against the petitioner.
5. Considering the period of incarceration and also considering that no previous case is pending against the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions.
6. Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction 2/4
of the learned Judicial Magistrate, Karaikudi, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
