Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents 1 to 3 to take necessary and appropriate action on the representation, dated 17.10.2024 and consequently direct the respondents to issue patta in the name of the petitioner for lands comprised in S.No.237/2A, 237/2B, 237/2C, 238/1, 238/2, 238/5, 238/7, 263/2, 266/1, in patta No.1109 to the extent of 1.51.50 Hectares of Vilangudi Additional Village, Thiruvaiyaru Taluk, Thanjavur District., S.No.237/4A, 237/4B, 237/4C, 237/6, 237/7A, 237/7B, 237/7C, 237/8A, 237/8B, 237/8C and 239/4 in patta no. 1125 to the extent of 1.19.50 Hectares of Vilangudi Additional Village, Thiruvaiyaru Taluk, Thanjavur District and in S.No.459/4, 459/6, 464/10 to the extent of 0.17.00 Hectares in Patta No.1017 of Vilangudi Muthanmai Village, Thiruvaiyaru Taluk, Thanjavur District. ORDER

The petitioner has made an application on 13.05.2024 seeking to cancel the patta issued in favour of the respondents 5 to 11 and consequently, issue a patta in the name of the petitioner. The said petition has not been processed by the respondents. Therefore, the petitioner has sent a reminder on 17.10.2024 which is also not been taken note of. Therefore, the petitioner is before this Court.

2. The petitioner claims a right to the property in question to one S.Jeyalakshmi w/o Saundaresan Pillai. The said Saundaresan Pillai passed away and the property is devolved upon the said Jeyalakshmi as the sole surviving legal heir. The revenue records were mutated in her name. She had executed a registered Will on 13.08.2014 bequeathing the properties in favour of the petitioner. After her demise on 14.08.2014, the petitioner had made a representation to the Sub Registrar, Tanjavur District for issuance of patta. However, no steps were taken in 2014.

Since the application has been made in the year 2014 and no steps have been taken to date, the petitioner is before this Court.

3. Therefore, a mandamus is issued to the 1st respondent to consider the representations of the petitioner, dated 13.05.2024 and 17.10.2024 and pass orders within a period of two (2) months from the date of receipt of copy of this order.

4. With the above directions, this Writ Petition stands allowed. No costs. Consequently, connected Miscellaneous Petition is closed. 28.10.2024 NCC : Yes/No Index : Yes/No Internet : Yes gbg To 1.The District Collector,
