... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to conduct enquiry based on the representation given by the petitioner dated 27.09.2024.
For Petitioner : Mr.P.Edin Brough For Respondents : Mr.E.Antony Sahaya Prabahar Additional Public Prosecutor 1/4
ORDER
The Writ Petition has been filed seeking orders to direct the respondents to conduct enquiry based on the representation given by the writ petitioner dated 27.09.2024.
2. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3. The learned Additional Public Prosecutor appearing for the respondents would submit that previously the opposite party has filed a writ petition in W.P.(MD)No.23064 of 2024 and the same was ordered to be disposed of and that on the basis of the complaint given by the writ petitioner, summons was issued directing her to appear before the second respondent but the writ petitioner, after receipt of the summons, has sent a reply to the second respondent seeking particulars and directed them to furnish some documents so as to enable her for attending enquiry. 2/4
4. It is pertinent to note that summons came to be issued only on the basis of the complaint given by the writ petitioner but she has not chosen to appear before the second respondent. Since the writ petitioner is not co-operating with the enquiry, the question of issuing direction to the respondents does not arise at all.
5. In the result, the Writ Petition stands dismissed. No costs. 23.10.2024 NCC :Yes/No Index :Yes/No Internet : Yes/ No csm To 1.The Superintendent of Police, Thanjavur District.
