ORDER

This Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders, to direct the respondent police to file final report 1/4

in Crime No.716 of 2020 before the learned Judicial Magistrate, Additional Mahila Court, Nagercoil within time stipulated by this Court.

2. The learned counsel for the petitioner would submit that the petitioner and three others have earlier filed a petition in Crl.O.P(MD) No.18250 of 2023, to quash the FIR in Crime No.716 of 2020 and this Court, by considering the submission made by the learned Government Advocate (Criminal Side) that charge sheet has already been filed before the jurisdictional Court, dismissed the petition as infructuous. He would further submit that the respondent police has not filed the final report so far.

3. The learned Additional Public Prosecutor appearing for the State would submit though charge sheet was filed earlier, the same was returned for rectification of some defects and the same is yet to be resubmitted and seeks two weeks time for resubmitting the charge sheet.

4. Recording the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition stands disposed of. The 2/4

respondent Police is directed to re-submit the charge sheet, after rectifying the defects pointed out by the learned Magistrate, within a period of two weeks from the date of receipt of copy of this order. 23.10.2024 NCC : Yes / No Index : Yes / No Internet : Yes / No das To 1.The Inspector of Police, Kanyakumari Police Station, Kanyakumari District.
