Respondent PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to pay the petitioner interest at the rate of 6% per annum, for the period of delay from 01.06.2022 to 30.05.2023, in paying the amounts paid towards his terminal benefits namely EPF Employee's Contribution, Gratuity and Encashment of Leaves/Already Surrendered Earned Leaves within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits.

ORDER

The present writ petition has been filed by a retired Conductor of the respondent Corporation seeking a Mandamus to direct the respondent to pay the interest for the belated settlement of terminal benefits.

2. The petitioner had attained superannuation on 31.05.2022. His terminal benefits were released only on 30.05.2023. The petitioner has sent a representation on 17.08.2023 seeking interest for the belated disbursement of the terminal benefits.

3. In view of the above said facts, the respondent herein is directed to pay interest at the rate of 6% per annum from the date of his retirement till the date on which the terminal benefits were disbursed to the writ petitioner within a period of twelve (12) weeks from the date of receipt of a copy of this order.

4. With the above said observations, this Writ Petition stands disposed of. No costs.
