For Respondent : Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime no.520 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent 1/3

police for the offences punishable under sections 8(C) r/w. 20(b)(ii) C, 25 and 29(1) of NDPS Act, in Crime No.520 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on receiving secret information, the respondent police has conducted a raid on 22.09.2023 and at that time, the petitioner herein and other accused have illegally found in possession of 21 Kgs of Ganja. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and she has not committed any offence as alleged by the prosecution and her name has been falsely implicated in this case. He would further submit that based on the confession of co-accused the petitioner herein is arrayed as accused and hence, seeks anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent police would submit that the contraband recovered is commercial quantity and the investigation of the case is pending and hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the fact that the contraband recovered is a commercial quantity, this Court is not inclined to grant anticipatory bail to the petitioner.
