To call for the records pertaining to the impugned judgment dt. 13.08.2024 in Criminal appeal no. 76 of 2024 passed by the Additional District Judge (Fast track court) Theni by confirming the judgment dt. 29.04.2024 in STC No. 4/2024 passed by the learned Judicial Magistrate (Fast Track Court), Uthamapalayam and set aside the same.
Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.M.DINESH HARI SUDARSAN, Advocate for the petitioner, the Court made the following order:- 1/3
Today, this matter has been listed under the caption "for reporting compliance".
2. This Court had already passed a conditional order on 25.09.2024, in Crl.M.P. (MD)No.10107 of 2024 in Crl.R.C.(MD)No.914 of 2024, directing the petitioner to deposit a sum of Rs.10,00,000/- (Rupees Ten Lakhs only) to the credit of S.T.C.No.4 of 2024 on the file of the learned Judicial Magistrate, Fast Track Court, Uthamapalayam on or before 22.10.2024. Thereafter, the matter was listed for reporting compliance on 24.10.2024. On that date, the learned counsel for the petitioner had filed a petition, in Crl.M.P.(MD)No.11188 of 2024 in Crl.R.C.(MD) No.914 of 2024, seeking extension of time for complying with the direction of this Court in its order, dated 25.09.2024, in Crl.M.P.(MD)No.10107 of 2024 in Crl.R.C. (MD)No.914 of 2024. The said petition was allowed by this Court on 24.10.2024, and further time was granted to the petitioner till 14.11.2024 to deposit the above said amount of Rs.10,00,000/- (Rupees Ten Lakhs only). Thereafter, the matter was adjourned to 15.11.2024 for reporting compliance.
3. When the matter is taken up for hearing today, the learned counsel for the petitioner submitted that so far, the petitioner has not complied with the direction of this Court, dated 25.09.2024.
4. Hence, the relief of suspension of sentence granted to the petitioner by this 2/3
Court on 25.09.2024, in Crl.M.P.(MD)No.10107 of 2024 in Crl.R.C.(MD)No.914 of 2024, is hereby cancelled.
