ORDER

The petitioner is wife of the fourth respondent. She filed an application for maintenance against her husband. Pending the application an agreement was arrived between them that on the date of retirement, from the retirement benefits the fourth respondent would settle some amount. Based on the agreement, the petitioner has made a request to the 2nd and 3rd respondents for attaching the retirement benefits of the fourth respondent.

2. According to the learned Government Advocate, even before her request the fourth respondent got voluntary retirement on 28.07.2022 and all the terminal benefits have been settled to the fourth respondent. In the absence of any directions from the Court, they cannot attach the salary and other retirement benefits and therefore, they settled the benefits. 2/4

3.When this writ petition was taken up for hearing on 06.12.2024 there was no representation for the petitioner. Therefore, this writ petition was directed to be listed under the caption 'for dismissal' today. 4.Accordingly this writ petition is listed under the caption 'for dismissal' today. Despite the same, there is no representation for the petitioner. Therefore, this writ petition is dismissed for non prosecution.
