Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned rejection order of the 2nd respondent, dated 25.07.2024 vide Application No.2024/N105/24/000182, dated 01.04.2024 and quash the same and also directing the 2 to 4 respondents to execute the Survey work based on the F-Line Application in 2024/N123/24/008110, dated 16.09.2024 and to pass Sub-Division and Patta transfer proceedings in favour of the petitioner pertaining to the vacant site in S.No.332/15E comprising an extent of 4 Cents (1744 Sq.ft.) in Joint Patta No.1435 at Thanichiyam Village, Vadipatti Taluk, Madurai District within a time frame as pleased by this Court. ORDER
The petitioner is aggrieved by the rejection of his request for transfer of patta by one line order, namely "The application 2024/N105/24/000182 is rejected by Tahsildar on 25.07.2024".
2. The petitioner is at loss to understand as to the ground on which his request has been turned down. Therefore, he is before this Court seeking to quash the rejection order, dated 25.07.2024 of the 2nd respondent and direct the respondents to survey and demarcation and to transfer the patta in the name of the petitioner.
3. Heard the learned counsel on either side.
4. The impugned order neither provide any reason for the rejection nor indicate the basis on which the 2nd respondent had arrived at a decision to reject the request. Therefore, this Court is inclined to quash the impugned order. Accordingly, the impugned order passed by the 2nd respondent, dated 25.07.2024 is quashed and the matter is remitted back to the 2nd respondent and the request shall be considered afresh and a speaking order shall be passed within a period of six (6) weeks from the date of receipt of copy of this order.
