ORDER

This Criminal Original Petition filed, under Section 528 of BNSS., seeking orders, to call for the records pertaining to the FIR in Crime No.1422 of 2023, dated 06.12.2023 on the file of the first respondent police for the offence under Sections 294(b), 323, 324 and 506(i) IPC and quash the same as illegal.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the State would submit that on the basis of the complaint given by the second respondent, FIR came to be registered in Crime No.1422 of 2023 and after completing the investigation, they have filed the charge sheet before the learned Judicial Magistrate No.II, Madurai, through e-filing No.C2024 00634.

3.The learned counsel appearing for the petitioners would submit that they have applied for certified copy of the charge sheet, but the same was returned by the learned Magistrate stating that the case in Crime No.1422 of 2023 is in FIR stage.

4. Recording the submission made by the learned Government Advocate (Criminal Side), the learned Judicial Magistrate No.II, Madurai, is directed to take the charge sheet on file, if it is otherwise in order. The petitioners are at liberty to challenge the charge sheet, if so advised.
