2. The learned Government Advocate for the petitioners fairly submits that this issue is now set to rest by the Division Bench of this Court and the Special Leave Petition filed by the State is also dismissed.

3. The learned Single Judge has also relied upon the earlier order passed by the Division Bench in similar writ petition.
