JUDGMENT

[Judgment of the Court was delivered by D.KRISHNAKUMAR, J.] The issue raised in this writ appeal is no longer res integra in view of the fact that in a similar matter, the Division Bench dismissed the appeals filed by the Department in W.A.(MD)No.520, 521, 1412, 1536 and 1585 of 2023 by an order dated 01.12.2023 and the Special Leave Petitions in SLP Nos.2451 to 2455 of 2024 filed against the order of the Division Bench were also dismissed by the Hon'ble Supreme Court.
