ORDER : The Court made the following order :- The petitioner/A1, who is facing a case for the offence under Section 379 of IPC, in CC.No.474 of 2015 pending on the file of the learned Judicial Magistrate No.II, Kovilpatti, in Crime No.798 of 2015 on the file of the respondent police, seeks bail.
2.The petitioner was absent during the trial in CC.No.474 of 2015 pending on the file of the learned Judicial Magistrate No.II, Kovilpatti. Therefore, Non-Bailable Warrant came to be issued on 27.05.2024 and the same was executed on 04.09.2024. From onwards, he is in judicial custody. Hence, the petition.
3. The learned counsel for the petitioner would submit that the custodial interrogation of the petitioner is not necessary since the trial is proceeding, and hence, the petitioner shall be enlarged on bail.
4. Considering the crime number is of the year 2015 and considering the fact that out of 8 witnesses, 7 witnesses have already been examined, and the case was posted to 24.10.2024 for the examination of the last witness, and that the trial itself 2/4
can be completed very soon in any event, within a period of one month, I am not inclined to enlarge the petitioner on bail.
5. Accordingly, this Criminal Original Petition stands dismissed.
6. Since the prayer of the petitioner to release on bail is dismissed, the prosecution shall take steps to produce L.W.8 on 24.10.2024, and a copy of this order shall also be produced before the trial court to complete the case as expeditiously as possible.
