Prayer in Crl.O.P.(MD)No.13619 of 2024:- Criminal Original Petition filed under Section 528 of BNSS,todirect the Learned Special Court for Exclusive Trial of Cases under SC/ST (PoA) Act 1989, Theni to accept the surrender of the petitioner and consider his bail application on the same day on merits in relating to Crime No.236 of 2024 dated 08.07.2024 on the file of the respondent police.
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.Srikanth, Advocate for the Petitioner and of Mr.E.Antony Sahaya Prabahar Additional Public Prosecutor, for the respondents, and upon perusing the earlier order dated 20.08.2024,this Court made the following order:
This petition has been filed seeking extension of time to surrender of the petitioners before the Special Court for Exclusive Trial of Cases under SC/ST (PoA) Act 1989, Theni, as ordered by this Court in Crl.O.P.(MD)No.13619 of 2024 dated 20.08.2024.
2. The learned counsel appearing for the petitioners would submit that the petitioners could not surrender before the learned Sessions Judge and produce the sureties within the stipulated time as prescribed by this Court.
3. Considering the submission made by the learned counsel appearing for the petitioners, this petition is allowed and time is extended by ten days from the date of receipt of copy of this order.
