Prayer in CRL.O.P.(MD)No.14983 of 2024:- Criminal Original Petition filed under Section 528 of B.N.S.S., to direct the Special Court for exclusive trial of cases under SC/ST (PoA) Act, 1989, Theni, to accept the surrender of the petitioner and consider bail application on the same day on merits in relating to crime no.233/2024 date 06/7/2024 on the file of the respondent police.
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.Srikanth, Advocate for the Petitioner and of Mr.E.Antony Sahaya Prabahar, Additional Public Prosecutor for the respondents and upon perusing the earlier order dated 06.09.2024, this Court made the following order:
This petition has been filed seeking extension of time to surrender of the petitioner before the Special Court for Exclusive Trial of Cases under SC/ST (PoA) Act 1989, Theni, as ordered by this Court in Crl.O.P.(MD)No.14983 of 2024 dated 06.09.2024.
2. The learned counsel appearing for the petitioner would submit that the petitioner could not surrender before the learned Sessions Judge and produce the 2/4
sureties within the stipulated time as prescribed by this Court.
3. Considering the submission made by the learned counsel appearing for the petitioner, this petition is allowed and time is extended by ten days from the date of receipt of copy of this order.
