Criminal Original Petition filed under section 482 of Criminal Procedure Code, to direct the respondents to give police protection to the petitioner's life and property situated at old Survey No. 238/6 to new Survey No. 238/7 a property situated at kathiramangalam Village, Thiruvidaimarudhur Taluk, Thanjavur District and also to instruct the second respondent to provide sufficient police protection at the time of surveying the land based on the complaint dated 13.11.2019 submitted to the second respondent.

This Criminal Original petition has been filed to direct the respondents to give police protection to the petitioner's life and property situated at old Survey No. 238/6 to new Survey No. 238/7 a property situated at kathiramangalam, Village, Thiruvidaimarudhur Taluk, Thanjavur District and also instruct the second respondent to provide sufficient police protection at the time of surveying the land based on the complaint dated 13.11.2019 submitted to the second respondent.

The learned counsel for the petitioner would submit that the petitioner's father is the absolute owner of the property comprised in old survey No. 238/6 to new Survey No.238/7 to an extent of 10 cents situated at Kathiramangalam Village, Thiruvidaimaruthur Taluk, Thanjavur District . Therefore he want to survey the property and he approached the concerned revenue officials by way of proper application and also paid requisite fee https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P(MD).No.17526 of 2019 to survey his land before the concerned Tahsildhar. Even then the third respondent is objecting the same and he is not allowing to survey the land of the petitioner.

Considering the above facts and circumstances of the case, If the Surveyor is directed to survey the land as requested by the petitioner, and If the Surveyor feels any hindrance to survey the land belonging to the petitioner, he can very well seek police protection before the second respondent. If any complaint lodged by the Surveyor while surveying the land seeking police protection, the second respondent is directed to consider the same and pass orders on merits and in accordance with law after conducting enquiry with the second respondent.
4. With the above observation and direction, this Criminal Original Petition stands disposed of.
