Heard both sides.
2. The petitioner and Ramalingam are brothers. Ramalingam is no more. The grievance of the writ petitioner is that in respect of the petition mentioned four items of property, exclusive patta could not have been issued in favour of Ramalingam. He therefore sought inclusion of his name as joint pattadar. The petitioner's request was rejected by the Tahsildar, Manamadurai vide order dated 01.11.2022. The same is put to challenge in this writ petition.
3. Even though the contentions advanced by the writ petitioner are persuasive, since all the relevant materials are not before me, I relegate the petitioner to exhaust the appeal remedy. The petitioner is 2/4
3 W.P.(MD)NO.26243 OF 2022 permitted to file an appeal before the Revenue Divisional Officer, Sivagangai within a period of four weeks from the date of receipt of a copy of this order. If such an appeal is filed within the time limit, it should be entertained without reference to limitation. The Revenue Divisional Officer shall dispose of the matter on merits and in accordance with law within a period of three months, thereafter. The petitioner shall be given an opportunity of personal hearing by the Revenue Divisional Officer before passing final order. This writ petition stands disposed of accordingly. No costs.
