JUDGMENT

[Judgment of the Court was made by R.SUBRAMANIAN, J.] Mr.S.Govindan, learned counsel takes notice for the respondent. 2.The order of the Writ Court granting interest at 9% per annum for belated payment on pensionary benefits is under challenge. 3.Admittedly the benefits were refused resulting in the respondent moving this Court in W.P.(MD)No.461 of 2013 and the said Writ Petition was allowed on 02.03.2015. The Transport Corporation challenged the same upto the Hon'ble Supreme Court and finally, the pensionary benefits were settled only in the year 2018. Admittedly, there was a delay in payment of the said benefits. Hence, the Writ Court had granted interest at 9% only. We do not see any reason to interfere with the discretion exercised by the Writ Court.

4.The Writ Appeal fails and it is accordingly dismissed. No Costs. Consequently, connected miscellaneous petition is closed. [R.S.M., J.] [L.V.G., J.] 28.10.2024 NCC :Yes/No Index :Yes/No Internet: Yes Mrn
