ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. M. Arikaran, Advocate for the Petitioner and of Mr. R. Suresh Kumar, Government Advocate (Criminal side) for the respondents 1 & 2, this Court made the following order:
"When the case came up for hearing, the learned Counsel appearing for the Petitioner submitted that due to illness of the Petitioner's wife, the Petitioner was unable to comply with the order passed in Crl.M.P(MD)No.459 of 2022 in Crl.O.P(MD)No.17792 of 2022, dated 12.01.2022 and surrender before the learned II Additional District and Sessions Judge (PCR Act Cases), Tirunelveli. Now, he is ready to surrender before the learned II Additional District and Sessions Judge (PCR Act Cases), Tirunelveli. 2.The learned Government Advocate (Crl.Side) objected for granting further time and stated that this is the second criminal miscellaneous petition filed by the Petitioner seeking for extension of time.
3.In the light of the reasons stated by the learned Counsel appearing for the Petitioner, this Criminal Miscellaneous Petition is allowed. Based on the submission made by the learned Government Advocate (Crl.Side), the Petitioner is warned and he is granted further time of two weeks from the date of receipt of a copy of this order or from the date of uploading of this order on the website of this Court, to surrender before the learned II Additional District and Sessions Judge (PCR Act Cases), Tirunelveli."
