RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to direct the Judicial Magistrate Vedasandur to return the amount a sum of Rs.3,00,000/- deposited by the petitioners to the credit of Cr.No.19/2022 on the file of the respondent.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MAYILVAHANA RAJENDRAN.C, Advocate for the petitioner and of MR.M.VEERANTHIRAN, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to direct the learned Judicial Magistrate, Vedasandur to return the amount of Rs.3,00,000/- deposited by the petitioners to the credit of Crime No.19 of 2022 on the file of the respondent police.

2.The learned counsel for the petitioners as well as the learned Government Advocate (Crl. side) would submit that after investigation, the respondent police has filed the final report as 'Mistake of Fact'.

3.In view of the same, the petitioner is permitted to withdraw the amount of Rs.3,00,000/- which was deposited in crime No.19 of https://www.mhc.tn.gov.in/judis 1/2

CRL MP(MD) No.14433 of 2022 2022. The learned Judicial Magistrate, Vedasandur, is directed to return the said amount of Rs.3,00,000/- to the petitioners without filing any formal petition.

4.With the above directions, this Criminal Miscellaneous Petition is disposed of.
