Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of certiorari, to call for the records relating to the impugned resolution of the 1st respondent in Item No.134/24, dated 01.07.2024, and the consequential gazette notification published by the

respondent in L.R.RC.No.1382/08/B7/TNJ, dated 23.08.2024, and quash the same as illegal.

ORDER

Today, when the matter is called, a resolution, dated 22.10.2024, is circulated, wherein it is resolved as under : ''In compliance to the direction of the Hon'ble High Court in W.P. (MD) No.25014 of 2024 this Board hereby withdraws the resolution in Item No.134/24 R.C.No.1382/08/B7/TNJ dated 01.07.2024 The Board hereby further resoles to summon the Members of the Committee for further action in the next Board Meeting in accordance with provisions of the Waqf Act,1995.''

2. Added to the above, learned counsel for the petitioner also makes an endorsement to the effect that the present Writ Petition is withdrawn. The endorsement reads as under :

''The present Writ Petition is withdrawn as the direct management has been revoked and resolution withdrawn.''

3. Impleading petition in W.M.P.(MD) No.21905 of 2024 is not pressed. However, the petitioner therein seeks liberty to challenge the resolution. It is always open for the parties to avail the remedy, that may be available to them in the manner known to law, if they are aggrieved by any order.

4. Writ Petition is dismissed accordingly. No costs.
