ORDER

This Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders to direct the learned Judicial Magistrate No.1, Tirunelveli to expedite the case in C.C.No.130 of 2017 pending on his file and dispose of the same as expeditiously as possible within the time stipulation as prescribed by this Court.

The learned counsel appearing for the petitioner would submit that the petitioner has filed a private complaint and the same was taken cognizance in C.C.No.130 of 2017, that the accused has been purposely protracting the proceedings by allowing to issue warrant one by one and that is why the case is pending for the past seven years and that therefore the petitioner is constrained to file the present petition.

3. It is seen from the B-Diary extract that warrant came to be issued to the accused one by one and subsequently, warrant came to be recalled at their instance.

4. Considering the above and also the fact that the case is pending from 2017 onwards, the learned Judicial Magistrate No.1, Tirunelveli, is directed to complete the trial in C.C.No.130 of 2017 and dispose of the same within a period of four months from the date of receipt of a copy of this order.

5. With the above direction, this Criminal Original Petition stands disposed of.
