Petition filed under section 482 of Criminal Procedure Code, to call for the records pertaining to Spl.C.C.no.99 of 2019 on the file of the III Additional District and Sessions Court (PCR) Madurai and quash the same as illegal.

ORDER:

This Petition coming up for hearing on this day, upon perusing the earlier order of this Court dated 28.11.2019 and the requisition letter of the III Additional District and Sessions Court (PCR), Madurai vide letter in D.No.558 dated 18.11.2020, and upon the arguments of Thiru.A.Prasanna Rajadurai, Advocate for the petitioner and this Court made the following order :- By order dated 28.11.2019, this Court directed the Court below to complete the trial in Sp.C.C.No.99 of 2019 within a period of 6 months from the date of receipt of copy of the order. 2.The Court below has submitted a letter in D.No.558 dated 18.11.2020 wherein, the learned Judge stating that he assumed charge only on 21.09.2020 and the case came up before him for the first time on 18.11.2020 and before that due to Covid-19 lockdown, physical hearing was not allowed, has requested for extension of six months to comply with the above order.

3.There is no objection on the side of the petitioner in extending the time limit.

4.Therefore, six months time is extended from the date of receipt of this order to comply with the order dated 28.11.2019.
