PRAYER :- For Bail in Crime No.98 of 2022 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 13.07.2023 for the alleged offence punishable under Sections 302 IPC altered into Sections 120(b), 1/3

302 IPC r/w Section 34 IPC in Crime No.98of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that due to previous enmity, the accused persons attacked the deceased with deadly weapons and caused death. Hence the case.

3.The learned counsel appearing for the petitioner would contend that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is is custody from 13.07.2023, hence he seeks bail.

4.The learned Additional Public Prosecutor appearing for the respondent Police would submit that now, investigation completed and charge sheet also filed in S.C.No.307 of 2022, which is pending on the file of the Additional District Judge No.I, Thoothukudi. So far P.W.1 to P.W.11 were examined and the case was posted for further examination of prosecution witnesses. The evidences also deposed as against the petitioner herein. Hence, he strongly objected to grant bail to the petitioner. 5.Heard both sides and perused the materials available on record. 2/3
