PRAYER :- For Bail in Crime No.188/2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/A4, who was arrested and remanded to judicial custody on on 16.09.2023 for the alleged offence punishable under Section 394 of IPC in Crime 1/3

No.188 of 2023, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 15.09.2023 at about 3.30 pm., when the defacto complainant and her sister were returning home after shopping the petitioner and other accused came from backside and snatched the neck chain of the defacto complainant and ran away from the place of occurrence. Hence the case.

3. The learned counsel appearing for the petitioner would contend that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the property has been recovered and the name of the petitioner not found place in the the First Information Report. He would further submit that the petitioner is in custody from 16.09.2023, hence he seek bail.

4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that petitioner along with other accused came behind the defacto complainant and snatched her neck chain and ran way, hence, he strongly objected to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances and also taking into consideration the gravity of offence committed by the petitioner and also the fact that the investigation is in initial stage, this Court is not inclined to grant bail to the petitioner. 2/3

7. Hence the petition stands dismissed.
