ORDER

This criminal original petition has been filed seeking orders to quash the First Information Report in Cr.No.146 of 2022 dated 13.04.2022.

2.The learned counsel appearing for the petitioner would submit that though final report came to be filed on 23.12.2022, the case is not yet taken on file and hence, the petitioner was constrained to file this petition.

3.The learned Government Advocate(Crl.Side) appearing for the first respondent would submit that final report came to be filed deleting three accused and hence, the learned Judicial Magistrate, Theni taking the case in Crl.M.P.No.76 of 2023 and issued notice to the second respondent, that on receipt of the notice, the second respondent entered appearance and the petition is pending.

4.Considering the submissions made on either side, the learned Judicial Magistrate, Theni is directed to complete the enquiry in Crl.M.P.No.76 of 2023, within a period of one month from the date of receipt of a copy of this order. Accordingly, this criminal original petition is disposed of.
