PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents to sanction and disburse the pro rata pension to the petitioner under rule 34 of The Tamil Nadu Pension Rules, 1978 based on the petitioners on the petitioner's representation dated 27.06.2024.

ORDER

The instant writ petition has been filed by a retired Assistant Veterinary Surgeon seeking a mandamus as against the first respondent herein to consider his representation dated 27.06.2024, so that the services rendered by him in the first respondent department could be calculated for the purposes of pro-rata pension.

2.A perusal of the counter affidavit indicates that the petitioner was originally appointed as Assistant Veterinary Surgeon in the first respondent and he was deputed to State Bank of India on 28.10.1974. The petitioner has resigned the post on permanent absorption by the State Bank of India. The resignation letter was accepted and the petitioner was relieved from the first respondent department on 03.09.1978. The petitioner after serving in State Bank of India on a permanent basis, has retired on 31.10.2000. On 27.06.2024, the petitioner has given a representation to the first respondent herein seeking pro-rata pension for the services rendered by him in the said department. Since the said representation has not been considered, the present writ petition has been filed.

3.Considering the above said facts, the first respondent herein is directed to consider the request of the writ petitioner dated 27.06.2024 and pass orders on merits and in accordance with law with a period of twelve weeks from the date of receipt of a copy of this order.

4.With the above said observations, this writ petition stands disposed of. No costs.
