the fraudulent act of the 3rd respondent and other officials to obtain Legal Heirs Certificate no.TN 7201808012161 dated 30.08.2018 and takes necessary action in accordance with law.

ORDER

This writ petition has been filed for the following relief : "to call for the records in Legal Heirs Certificate No.TN 7201808012161 dated 30.08.2018 issued by the 2nd respondent herein and quash the same and consequently directing the 1st respondent to conduct detailed enquiry for the fraudulent act of the 3rd respondent and other officials to obtain Legal Heirs Certificate no.TN 7201808012161 dated 30.08.2018 and takes necessary action in accordance with law."

2. The case of the petitioner is that her husband, namely Beer Mohameed died on 03.06.2018 leaving behind the petitioner and her daughter as his legal heirs. While so, the 3rd respondent obtained a legal

heir certificate from the 2nd respondent fraudulently that she is the wife of the deceased Beer Mohameed. Seeking to quash the same, the petitioner is before this Court.

3. Heard the learned counsels on either side.

The petitioner had filed O.S.No.93 of 2018 on the file of the District Munsif Court, Bodinayakanur for declaration that the plaintiffs are the only surviving legal heirs of the deceased Beer Mohameed. The 3rd respondent has been shown as the 3rd defendant in the said suit. The suit has been decreed by the District Munsif, Bodinayakanur by judgment and decree dated 05.03.2021.

5. In the light of the above, the impugned legal heirship certificate issued by the 2nd respondent is set aside and the 2nd respondent is directed to issue a fresh legal heirship certificate to the petitioner and her daughter, namely Shakeela Banu.

6. With the above directions, this Writ Petition stands allowed. No costs. Consequently, connected Miscellaneous Petitions are closed. 19.11.2025 NCC : Yes/No Index : Yes/No Internet : Yes gbg To 1.The District Collector, Madurai District.
